Amendment C92: Including the former Tontine Factory site

Status

The Minister for Planning has approved Amendment C92 to the Moreland Planning Scheme. The amendment came into effect on  20 January 2011. Council adopted Amendment C92 at its meeting on 14 July 2010.    

About the Amendment

Amendment C92 affects the land generally bound by Nicholson Street, Glenlyon Road, John Street and Albert Street in Brunswick East, and includes the former Tontine factory site.  Specifically, the Amendment applies to land with the following addresses:

  • 2 Elm Grove, Brunswick East
  • 80, 82, 98-100, 102, 104-106 John Street, Brunswick East
  • 115, 119 - 121, 123, 125, 127 – 137, 139, 149, 153, 153A, 155, 157 Nicholson Street, Brunswick East
  • 6-8 Gamble Street, Brunswick East
  • 257a, 257b Glenlyon Road, Brunswick East, and
  • 18, 1-7/20, 22, 24, 26, 28, 30, 32, 40, 42 Albert Street, Brunswick East.

The amendment :

  • Rezones land included in the Industrial 1 and Industrial 3 Zone to the Business 1 Zone and Business 2 Zone;
  • Applies the Environmental Audit Overlay to the land which is rezoned from the Industrial 1 Zone and Industrial 3 Zone;
  • Applies Schedule 11 to the Development Plan Overlay to the land;
  • Amends Clause 21.04 (Moreland's Vision) and Clause 21.05 (Key Strategic Statements) to identify the land as an urban village; and
  • Amends the schedules to the Business 1 Zone and Business 2 Zone to include a maximum combined leasable floor ares for shop 

Amendment C92 was placed on public exhibition from 17 September to 19 October 2009, in accordance with the requirements of the Planning and Environment Act 1987.  Council received 48 submissions to the proposed Amendment.

Amendment C92 was heard before Planning Panels Victoria over 4 days in December 2009.  Council received the report of the Panel in March 2010.  The Panel report can be viewed below.
