Consent and report of Council
If your building project does not meet a requirement of the Building Regulations 2006 you will have to apply to Council for a Report and Consent, before your building permit can be issued. This will be because of the way your architect designed the building. Your building surveyor will be able to tell you if a Report and Consent is required from Council.
You must get Council’s Report and Consent before a building permit is issued.
Common regulations that building projects need Report and Consent for are:
- Siting, Regulations 408 to 422, Regulations 424 to 431
- Projections and buildings above or below a street and certain public facilities, Regulations 513 and 515
- Public protection measures, Regulation 604
- Land liable to flooding, Regulations 802 and 806, and
- Building over easements, Regulation 310.
Each regulation has its own application form. To get Council’s consent, show how your design meets the Ministerial decision guidelines. The decision guidelines are on the application form.
For siting consents, Council also needs comments from the owners of adjoining properties. Council considers these comments when making its decision. Council has adopted procedures to inform you of which property owners should be notified for each siting application type. You can discuss the level notification with a building approvals officer by calling 9240 1111 or by attending the building counter at 90 Bell Street, Coburg. It can save you time and cost if you obtain the consent of adjoining land owners before you lodge your application.
You can request the contact address details for the owners of adjoining land before lodging your consent and report by completing a Building report and consent request for adjoining property ownership details form (DOC 59Kb) and submitting this to Council with a fee. Council will then provide you up to date details of adjoining property owners. Alternatively Council can complete this step for you as part of the application process.
Council has developed a form to assist you in obtaining the consent of adjoining land owners. There are two different forms depending on which Ministerial Guideline you need consent for. The forms are:

Report and Consent process
1. Find out which building regulation you need Report and Consent from Council for.
2. Download, print and fill in the Report and Consent Part A application form (DOC 54Kb).
3. Download, print and fill in the relevant Part B application form.
4. Attach 3 copies of plans of the building work.
5. Lodge your application with the plans and the consent fee:
- in person at Moreland Civic Centre, 90 Bell Street, Coburg, or
- by mail to Moreland Building Services, Locked Bag 10, Moreland, 3058.
